Lawyer: Bill 118 will deny legitimately injured people access to justice in Ontario

Bill introduced to give snow contractors a better chance for defence

A past president of the Ontario Trial Lawyers Association said the recent passing of Bill 118 will result in legitimately injured people being denied justice. “I am going to have to tell them they have lost their right to sue because they waited more than 60 days before they sent a letter out,” Steve Rastin of Rastin Gluckstein said. The bill was introduced to give property owners, tenants and snow and ice contractors a better chance to defend themselves from lawsuits.

    I think if I fell and injured myself, it would not take more than 60 days after the fact that I realized I was injured. Allowing two years to file a claim gave shady lawyers all the advantages and the property owner or contractor none. How does one produce evidence of due diligence two years after an event they knew nothing about?
    Excellent legislation!
